Terms & Conditions

PAYMENT TERMS

Unless otherwise expressly stated in the quotation, payment of the final invoice is strictly required within seven (7) calendar days from the date of issue.

Invoices not paid in full by the stated due date will be considered overdue immediately upon expiry of the seven-day payment period. A late payment fee of 5% of the outstanding invoice balance may be applied once the invoice becomes overdue, where this term formed part of the agreement accepted by the client.

The seven-day payment period refers to calendar days, not business days, and weekends and public holidays do not extend the payment period unless otherwise agreed in writing.

Any reasonable costs incurred by Ginnivan Gardening in pursuing or recovering an overdue debt may also be sought from the client where permitted by law and where recoverable under the agreement.

MATERIAL PAYMENTS & PROGRESS PAYMENTS

For larger projects, Ginnivan Gardening may require an upfront payment toward materials, progress payments during the works, or both.

These requirements apply only where expressly stated in the quotation or otherwise agreed with the client prior to commencement of the relevant works.

Where an upfront materials payment is required, Ginnivan Gardening is not required to purchase or order materials until the required payment has been received.

Where progress payments are specified, those payments must be made in accordance with the stages and payment terms set out in the quotation.

QUOTED PRICE & SCOPE OF WORKS

All quotations issued by Ginnivan Gardening are based strictly upon the Scope of Works specified in the quotation.

Unless otherwise expressly stated, the quoted price is a fixed job cost for completion of that Scope of Works and is not an hourly rate. The quoted price will therefore not increase or decrease solely because the works take more or less time than initially estimated.

Clients are responsible for reviewing the Scope of Works before accepting a quotation to ensure that all requested works have been included.

Any work requested or authorised outside the agreed Scope of Works is not included in the original quoted price and may incur additional charges. This may include additional labour, materials, equipment, travel, waste disposal or other costs reasonably associated with completing the additional works.

Where reasonably practicable, Ginnivan Gardening will advise the client of material additional costs before undertaking substantial works outside the agreed Scope of Works. Approved additional costs may be included in the final invoice.
